A Guide For Students and Employees on Sexual Harassment and Misconduct: What You Need to Know

This Title IX/Violence Against Women Act (VAWA) is intended to help you with obtaining information, getting support and assistance, and filing a complaint if you have experienced sexual harassment, sexual assault, domestic violence, dating violence, and/or stalking. A number of federal laws and regulations, including Title IX, VAWA, and the Clery Act, mandate how the college must respond to these offenses.

You are encouraged to report and may utilize any or all of the following options:

  • Make a complaint to an MCC Title IX Coordinator. This begins an administrative process that could result in college-related sanctions.This is not a criminal process.
  • Make a report to the appropriate law enforcement agency.This could result in criminal action being taken, such as criminal charges.
  • Engage with Confidential Support and Advocacy services. If reporting parties wish that the details of an incident be kept confidential, they should speak with resources that can maintain confidentiality.This will not result in any criminal charges or college-related sanctions.This does not limit your ability to report to law enforcement or the Title IX Coordinator in the future.
  • Seek medical care. A Sexual Assault Nurse Examiner (SANE) at the hospital will offer you a sexual assault forensic exam for DNA evidence collection as well as sexually transmitted infection (STI) prevention, HIV prevention, emergency contraception and injury evaluation and treatment.

The College is committed to responding to sexual harassment and is required by Federal Law to investigate all allegations and take remedial action deemed necessary to preserve your safety and that of the community, whether or not you wish to make a formal complaint. Employees of the college are expected to report all disclosures of sexual misconduct to the Title IX Coordinator.

Upon receiving a report, the Title IX Coordinator will reach out to the involved individual with resources and reporting options. Details regarding the procedures, as well as appeals, can be obtained by visiting the MCC Title IX webpages (www.mccneb.edu/Title-IX) or by contacting the MCC Title IX Coordinator.

A party should contact the Title IX Coordinator if they are interested in supportive measures. Supportive measures may be provided even if the reporting party does not want to file a formal complaint. “Supportive measures” means non-disciplinary, non-punitive individualized services designed to restore or preserve equal access to the College’s education program or activity without unreasonably burdening the other party. These measures are designed to protect the safety of all parties or the College’s educational environment, or deter sexual harassment. Supportive measures or remedies may include referrals to counseling, extensions of deadlines or other course-related adjustments, modifications of work or class schedules, campus escort services, mutual restrictions on contact between the parties, changes in work locations, leaves of absence, increased security and monitoring of certain areas of the campus, and other similar measures.

The College shall keep confidential the identity of any individual who has made a report or complaint of sex discrimination, including any individual who has made a report or filed a Formal Complaint of sexual misconduct, any Complainant, any Respondent, and any witness, except as may be permitted by the Family Educational Rights and Privacy Act (FERPA) or as required by law, or to carry out the purposes of Title IX, including conducting any investigation, hearing, or judicial proceeding arising thereunder. The College may be required to share information with other individuals in accordance with FERPA, Title IX, or other applicable law, including lawfully issued subpoenas in criminal, administrative, and civil matters.
